Chairman Scurlock fel*t he was hearing that whilethe <br />community does not want to go to commercial, they feel that some <br />restrictions are needed. <br />Attorney O'Haire pointed out that the reason they agreed to <br />the site plan process.i.s because they don't want to open it up to <br />new things; they just want the Board to recognize the uses that <br />are in place in this area and make them legal. <br />Commissioner Wheeler asked about the additional home <br />occupation uses listed.in the ordinance drafted by Attorney <br />O'Haire, such as metal workings, castings, contractors' offices, <br />lawnmower repairs, etc. <br />Attorney O'Haire explained that those uses are broken out <br />from the others to recognize uses that are in place in this area <br />and try to make them legal. <br />Commissioner Wheeler felt that some of the restrictions or <br />limitations would not apply, such as, "products that are not <br />offered for sale to the general public," or "any evidence of <br />occupation be screened from the street by landscaping." He <br />understood that some of these requirements would have to be <br />applied to existing businesses, and Attorney O'Haire stated that <br />these requirements would apply only if the existing businesses <br />are expanded. He realized that if Mr. Cury wishes to expand, he <br />will have to go through the site plan process. <br />Attorney Vitunac noted that if this ordinance passes as <br />written, Mr. Cury would still be in violation because he has <br />people working there who are not part of his family. <br />Attorney O'Haire understood that he would not be able to add <br />anyone new to his payroll outside of the family, but Attorney <br />Vitunac felt that the question is whether he would have to fire <br />people on his existing payroll. <br />Chairman Scurlock understood that the intent is to make him <br />legal and also let him come under the new ordinance. <br />Attorney O'Haire agreed that is what is intended, but felt <br />that if it reads otherwise, it needs to be addressed.
