wFE B 2 he M7 1 <br />BOOK 6 PAGE 423 <br />intended that this ordinance be retroactive in effect and make <br />Mr. Cury's business non -grandfathered and illegal. <br />Commissioner Eggert understood that the way the ordinance is <br />written would mean that if Mr. Cury's business burned down and he <br />wanted to rebuild, only his family could run the business. <br />Attorney O'Haire advised that the rule of thumb is that if <br />destruction is more than 50%, it comes under the new rules. <br />Robert Keating, Director of Planning 8 Development, <br />explained that the problem is that Code Enforcement does not have <br />a list of all the existing businesses. He suggested that the <br />Board establish a date whereby all existing businesses before <br />that date would be grandfathered in. <br />Commissioner Bird was concerned about how Mr. Cury would be <br />attected by the limitation of having the business run only by <br />those family members living on the site. He believed that Mr. <br />Cury's children will probably want to get their own places at <br />some point in the future. <br />Mr. Cury was concerned about that limitation also, and <br />stressed that he was legal for a long time before the zoning <br />changes grandtathered him. <br />Attorney O'Haire emphasized that they want to be able to <br />expand or sell. <br />Mr. Cury felt that because he has been there so long and <br />started out on a legal basis, he should not be zoned out of <br />business. He suggested that his business be addressed as <br />something unique. <br />Commissioner Bird felt that the problem is that Mr. Cury's <br />situation is not unique; there are many others like it up there. <br />He believed these small business people are the salt of the <br />earth. He was surprised, though, that more owners in that area <br />were not in attendance today. <br />Mr. Cury explained that many of the people who are running. <br />illegal businesses in that area are very afraid of being visible. <br />48 <br />
