contract documents state that the architect is the county <br />representative. <br />Administrator Balczun addressed the definition of "owner's <br />representative," and agreed that the architect does represent the <br />owner to some extent, but he emphasized that this Board has never <br />divested itself of the authority to make decisions binding the <br />county to financial obligations and certainly never devolved that <br />authority to an architect. <br />Commissioner Bird felt it appears that this contractor is <br />due to be reimbursed, but possibly the question is who reimburses <br />him - do we or the architect? He noted that he gets the feeling <br />there is something more underlying all this. <br />Administrator Balczun assured him that staff simply doesn't <br />feel it is a legitimate claim against the county. <br />Commissioner Wheeler stated it was his understanding that <br />nobody told them to put the trailer there; they simply put it <br />there and no one objected. <br />Chairman Scurlock wished to refresh the Board's memory re <br />the history of this situation. He noted that back when we began <br />the first phase of the Jail, because of the pressure from the <br />Department of Correction, we were looking to have this facility <br />built as quickly as possible. The other job this company had in <br />North Florida was way behind schedule, and we became concerned as <br />to why we weren't seeing construction started and our project <br />moved along. There is some suggestion in the correspondence from <br />Mr. Shimp that we hurried them and said put your construction <br />trailer here just so we so we could take some pictures to show <br />the community we were moving ahead, but the fact is that we had <br />to hurry them to get them started so the facility could be <br />completed on time. The Chairman also stressed that while the <br />drawings Mr. Shimp has of the site may not be exactly to'scale, <br />the dotted lines did show the future site of Phase II and that is <br />where they chose to locate. <br />59 � <br />BOOK 67 Ega 514 <br />
