WiAR 10 1987 Boor, U d <br />- The Conservation & Coastal Zone Management Element of the <br />Indian River Comprehensive Plan <br />Coastal Zone Management, Interim Goals, Objectives & <br />Policies for the Treasure Coast Region <br />- The Hutchinson Island Resource Planning & Management Plan <br />The Code of Laws &.Ordinances of Indian River County <br />Chapter 18-20, Florida Administrative Code <br />1) Application No. 31-130562-4: On January 13, 1983, the <br />County Planning and Zoning Commission granted site plan <br />approval for the Sea Oaks West development. Approved as' <br />part of the site plan was a proposal to construct a 15 <br />slip "T" formation boat dock to extend 110 into the Indian <br />River, subject to government agency permitting. The <br />proposal of a 48 slip docking facility is a substantial <br />increase and change from what was originally approved. In <br />accordance with County zoning ordinances, the new docking <br />facility proposal is subject to site plan review, at which <br />time impacts of the project can be evaluated in detail. <br />Preliminary concerns include impact on seagrass beds in <br />the River, manatee protection, and vehicular traffic/ <br />parking accommodations. <br />In addition to site plan review requirements, the project <br />is to be located in the Indian Indian River Aquatic <br />Preserve and therefore is subject to criteria set forth in <br />Chapter 18-20, Florida Administrative Code, enforced by <br />the Department of Natural Resources (DNR). <br />2) Application No. 31-130467-4: The observation dock <br />proposed in Orchid Isle Subdivision is to be located on <br />common area within the subdivision, and therefore is <br />subject to County site plan review procedures. If man- <br />groves are to be altered, a County mangrove alteration <br />permit is also required before approval. <br />The project is to be located in the Indian River Aquatic <br />Preserve and therefore is subject to criteria set forth in <br />Chapter 18-20, Florida Administrative Code, enforced by <br />DNR. <br />3) Application No. 31-130621-4: The single family lot at <br />12436 State Road AlA, owned by Mr. and Mrs. Zito, is <br />bisected by a "finger" wooded wetland approximately 25 <br />feet in width. The wetland is landlocked with no connec- <br />tion to a waterway and has been previously altered by <br />surrounding development. The applicant has received verbal <br />approval from Mr. Frank Buck, of the DER dredge and fill <br />permitting section that the area is exempt from DER, <br />permitting requirements. <br />A County mangrove alteration permit has been .issued by <br />staff in accordance with Chapter 23}, Tree Protection <br />Ordinance, of the County Code; a condition of the permit <br />is that a comparable number of red mangroves will be <br />planted along the Indian River shoreline on the subject <br />property as mitigation for those mangroves to be removed <br />as part of the fill project. In that shoreline mangroves <br />serve a valuable function as aquatic life habitat as well - <br />as shoreline stabilization, it is staff's opinion that the <br />mangroves planted as`mitigation will have a higher eco-. <br />logical value (once matured) than those removed as part of <br />th xoject. <br />
