4) Application No. 31-130635-4: The application submitted by <br />Ambrit Development Corporation for the dredging of an <br />artificial canal adjacent to Little Harbour Subdivision <br />indicates that -the canal is man made and has been <br />previously dredged.° However, representatives from the <br />Department of Natural Resources have expressed a concern <br />to. staff that the canal may have been a natural creek and <br />therefore subject to Aquatic Preserve review standards set <br />forth in Chapter 18-20, F.A.C. Therefore, staff recom <br />mends that the DER coordinate with the Department of <br />Natural Resources to determine if the project falls within <br />DNR jurisdiction. <br />The applicant is proposing to discharge material dredged <br />from the canal to land adjacent to the canal. The dredged <br />material is to be used on site for fill in association <br />with Little Harbour Subdivision which is presently under- <br />going County approval. Distribution of the fill will be <br />regulated in that a type "B" permit is required as per the <br />County Stormwater Management and Flood Protection Ordinance. <br />In the event that protected trees may be damaged as part <br />of the proposed project, County tree removal and/or <br />mangrove alteration permits are required prior to commence- <br />ment of the project, in accordance with Chapter 23J, Tree <br />Protection, of the County Code. <br />The application indicates that a turbidity curtain would <br />be installed at the mouth of the canal during excavation <br />to prevent silting of bottomlands within the Indian River. <br />RECOMMENDATION: <br />Staff recommends that the Board of County Commissioners aut- <br />horize staff to transmit a letter to the D.E.R. with the <br />following comments: <br />Application No. 31-130562-4 (R. Steven Pate, Applicant) <br />1) The Department of Environmental Regulation and other <br />appropriate agencies should coordinate with the DNR <br />in that the project is located in the Indian River <br />Aquatic Preserve and therefore subject to require- <br />ments of Chapter 18-20, Florida Administrative Code. <br />2) In January, 1983, the County granted approval for a <br />15 slip "T" formation dock facility at the site. The <br />proposed 48 slip dock facility is a substantial <br />change from that previously approved. Therefore, <br />construction of the project will not be permitted by <br />the County until the project undergoes County site <br />plan review to address potential impacts. <br />3) The Department of Environmental Regulation and other <br />appropriate agencies should evaluate the potential <br />impact of the project on ecologically significant <br />submerged bottomlands such as seagrass beds in the <br />Indian River. <br />4) The Department of Environmental Regulation and other <br />appropriate agencies should evaluate the potential <br />impact of the project on the Florida Manatee. <br />BOOK 67 Fr4iH 534 <br />
