BOOK <br />Section 2 <br />Amendments are made to Chapter 15 which ties in the General <br />Provisions section of the zoning code and requires that transient <br />merchants obtain both an occupational license and a transient <br />merchant temporary use permit. This section also prohibits the <br />"grandfathering -in" of existing operations when old "temporary" <br />permits expire. The new regulations will apply to any new and to <br />the existing transient merchant operations. <br />Section 3 <br />In this section transient merchants are specifically included in <br />the temporary use catagories listed in the agricultural and <br />commercial zoning districts. <br />Section 4 <br />This section establishes criteria -for the transient merchant <br />operations and application information requirements, and limits <br />transient merchants to fruit and vegetable sales and seasonal <br />sales. The criteria found on pages 3 and 4 [(a) through (g)] of <br />the proposed ordinance ensure that: <br />a) temporary, mobile facilities are utilized; <br />b) no utilities can be used, except temporary power for seasonal <br />sales; <br />c) all applicable sign regulations are met; <br />d) permitted access points conform with other county access/ <br />traffic requirements; <br />e) driveways are properly located and permitted; <br />f) parking spaces (temporary; no paving), in accordance with <br />what is required for temporary real estate sales offices, are <br />provided for; and <br />g) a separation distance, which does not affect any existing <br />permitted operations, is maintained between fruit and vegeta- <br />ble sales. <br />Application requirements, sorely needed to properly control <br />right-of-way and setback encroachments and to ensure conformance <br />with driveway and parking standards, are established on page 4(h) <br />of the proposed ordinance. Also, a cash bond requirement, sug- <br />gested by the transient merchants attending the December 1st <br />workshop, is established to eliminate site cleaning problems [p. <br />4(i)]. The $200.00 figure was provided by Public Works to cover <br />all loading, hauling, and dumping expenses and to discourage <br />transient merchants from actually forfeiting the cash bond and <br />paying the county to clean the site. <br />The remainder of Section 4 prohibits sales operations in rights- <br />of-way; exempts mobile ice cream sales, merchandise deliveries, <br />and catering services from transient merchant regulations; and <br />establishes the two types, of transient merchant operations al- <br />lowed: fruit and vegetable sales and seasonal sales. In accor- <br />dance with the proposed ordinance, all transient merchant tempo- <br />rary use permits would require approval by the planning_ director <br />whose decisions could be appealed to the Planning and zoning <br />Commission. <br />ALTERNATIVES: <br />There are essentially three alternatives for handling the tran- <br />sient merchant operations in Indian River County. <br />1.
