2. Prohibit transient merchant uses, "grandfathering -in" exist- <br />ing operations; or <br />3 Modify existing regulations to restrict uses and to establish <br />and apply specific criteria (standards). <br />Alternative number one would invite abuse of existing loopholes, <br />allowing all types of commercial sales meeting existing transient <br />merchant definitions, and would ignore the need for coordinating <br />Chapter 15 and General Provisions regulation and for existing <br />specific criteria for sales operations. <br />Alternative number two, employed by several counties, would <br />alleviate staff problems of reviewing new applications but would <br />also allow existing operations to continue without application of <br />adequate standards. A prohibition would also do away with fruit <br />and vegetable stands and seasonal sales which have traditionally <br />been permitted in Indian River County. <br />Alternative number three seeks to allow only certain types of <br />transient merchants that meet adequate traffic and parking stan- <br />dards. Sizes of operations would be limited by the type of <br />facilities allowed to be used while the number of operations would <br />be limited by zoning and separation district requirements. <br />At present, alternative number three and the corresponding <br />proposed ordinance presents a feasible way of handling existing <br />and potential problems with transient merchants by permitting <br />certain types of sales to operate under specified standards and <br />conditions. <br />RECOMMENDATION: <br />Staff recommends that the Board of County Commissioners adopt the <br />proposed transient merchant ordinance. <br />Stan Boling, Chief of Current Development, presented staff's <br />recommendation for the adoption of the proposed transient <br />merchant ordinance. <br />Commissioner Eggert asked if this will cover the sales of <br />automobiles at locations away from dealerships, and Mr. Boling <br />explained that sales events of that nature are not permitted <br />under the current temporary use permit criteria.
