Vitunac, County Attorney <br />DATE: April 1, 1987 <br />RE: AGENDA - BCC 4/7/87 <br />ATTORNEY'S MATTERS <br />GRAND HARBOR DEVELOPER'S AGREEMENT <br />In conjunction with the development of Grand Harbor it is <br />necessary for the developer to confirm the availability of <br />water and wastewater utility services for the project. The <br />attached two contracts, which toaether form a Developer's <br />Agreement, are recommended for approval by the County staff <br />and have been executed by the developer. <br />The agreements reserve 1,000 equivalent residential units <br />worth of water and wastewater capacity to Grand Harbor and <br />require that at least 250 ERUs be paid for in cash at the <br />time building permits are pulled or a higher number if the <br />number of building -permits requested exceeds 250. In <br />addition, simultaneously with the payment in cash, a letter <br />of credit must be issued in favor of the County for payment <br />of the remaining number of impact fees for which payment in <br />cash has not been made. <br />The developer will be responsible for constructing and <br />paying for water, wastewater, and effluent return lines from <br />his development to the County designated points of <br />connection. The Grand Harbor wastewater will be treated in, <br />the first one million gallons per day expansion of the <br />existing County wastewater plant. Ultimately a- second one <br />million gallons per day expansion will be constructed from <br />impact fees paid by Grand Harbor. <br />The second part of the Developer's Agreement is an effluent <br />return agreement which requires that all the effluent <br />generated from the wastewater treatment from Grand Harbor <br />will be returned to Grand Harbor for irrigation use on the <br />developer's golf courses.. <br />These agreements have been reviewed and approved by the <br />County Administrator, the OMB Director, the Director of the <br />Division of Utility Services, and this office, and are <br />recommended for approval by the Board of County <br />Commissioners. <br />86 <br />
