Commissioner Eggert stated that she has a lot of problems <br />with the changes in the replacement contracts given the Board, <br />especially with the 30 day delay between the payment for the 150 <br />ERUs and the arrival of the Letter of Credit and also with the <br />fact that they refer to timetables for construction, which she <br />has not seen and could not get hold of, nor is their any cash <br />flow analysis. She just felt with these changes we are treating <br />this differently than we have treated others i -n the county. <br />Chairman Scurlock had some of the same questions, but he did <br />not feel we are necessarily treating them differently because he <br />did not feel we have had the same situation. He advised that he, <br />the County Attorney, and the County Administrator all signed off <br />on the agreement that appears in the agenda backup material, but <br />he believed there is some misunderstanding about Paragraph 1. (d) <br />because there was no discussion with Mr. Schaub in regard to a 30 <br />day delay for presentation of the required irrevocable letter of <br />credit and also the entire letter of credit would be for the 1.8 <br />million. There would be $600,000 put up in cash. He confirmed <br />that there was supposed to be a construction schedule that would <br />be in line with the need for the money, and he has not seen this <br />as yet. <br />ON MOTION by Commissioner Eggert, SECONDED by Com- <br />missioner Wheeler, the Board unanimously tabled <br />action on the Grand Harbor Developer's Agreement <br />for one week to be studied by staff and until we <br />get the timetables and the cash flow analysis. <br />Discussion continued, and Attorney Henderson representing <br />Grand Harbor stated that they can wait a week, but just barely. <br />Commissioner Eggert noted that under the agreement for <br />delivery and use of reclaimed irrigation water, there is an <br />addition after one million gpd "or lesser amount as may be <br />permitted by the DER," and she would like to know any <br />87 <br />AP <br />. � BOOK. 60 864 <br />
