BOOK 68 FACE 3-8 <br />Immediately to the east of the subject property is the small <br />piece owned by the City which was rezoned to CI -A a few years <br />ago. It happens that the City and County's jurisdictions come <br />together there, but it comports in every way with the nodal <br />concept of development. Attorney O'Haire stressed that this area <br />has changed radically since the completion of the 17th Street <br />Bridge, and did not believe this area will remain residential. <br />The subject property represents an assemblage of 11 separate <br />ownerships, every one of which is entitled to access and the <br />right to use the property in the highest and best use. This <br />single application is an opportunity to address the access of the <br />entire parcel instead of having to consider access for 11 <br />separate properties, some of which run from one street to <br />another. He stressed that we are not talking strip zoning here <br />-- we are talking about 13 acres with 200-300 feet frontage along <br />a roadway. <br />Attorney O'Haire felt that there are really only two issues <br />involved in this matter, traffic and access, and the rest by and <br />large are paper tigers. He distributed maps of the area, and <br />noted that 17th Street east of Albertson's all the way to the <br />subject property is built out and in place; therefore, there <br />cannot be a domino effect for commercial zoning. It is <br />unfortunate that we do not have the machinery in place to do a <br />site plan and rezoning in•tandem, but he stressed that the <br />applicants are ready to do it if it could be done. <br />Chairman Scurlock asked staff if it is possible to create <br />such a vehicle so that we can consider a site plan when <br />determining zoning, and Mr. Shearer advised that we don't have <br />that mechanism under our current ordinances, but believed it <br />would be possible to devise such an ordinance. <br />Attorney O'Haire believed they would be perfectly happy with <br />such a vehicle, which in a sense, would be a PRD for commercial. <br />He believed the applicants could come up with a site plan in 90 <br />days while the proposed Comp Plan amendment is under review by <br />the State. <br />_ ®8 <br />
