Nearing REFERENCES: grand harbor <br />Staff Planner dyM DAVE3 <br />It is requested that ,the data presented herein be given formal <br />consideration by the Board of County Commissioners at their <br />regular meeting of April 14, 1987. <br />LOCATION AND DESCRIPTION: <br />Grand Harbor, Inc. has submitted a petition to abandon a 2,650 <br />foot portion of 53rd Street beginning at a point approximately <br />2,300 feet east of U.S. Highway 1. The petitioner owns all the <br />property surrounding this subject right-of-way. This portion of <br />53rd Street is entirely within the Grand Harbor project area, east <br />of the proposed Indian River Boulevard North. <br />The applicant has researched ,this portion of 53rd Street to <br />establish the roadway's actual status as a publicly dedicated <br />right-of-way. The search failed to disclose any deeds or other <br />recorded documents establishing this as actual public right-of- <br />way. However, in order to avoid any future questions concerning <br />the status of this portion of 53rd Street, the applicant has <br />initiated this petition for abandonment requesting that the County <br />abandon any possible claims which it may have to the right-of-way. <br />The applicant intends to utilize the property over which this <br />right-of-way lies as a portion of the River Club development of <br />Grand Harbor (recently added to the D.R.I. project area by the <br />County). Abandonment of this unnecessary portion of 53rd Street <br />would permit development per the proposed plans. <br />Per guidelines established by the Board of County Commissioners, <br />the petition was reviewed by all County divisions and utility <br />providers having possible jurisdiction within the right-of-way. <br />All reviewing agencies have recommended approval of the abandon- <br />ment. <br />ANALYSIS: <br />This 25 foot wide portion of 53rd Street is currently improved as <br />a marl road. In the past the principal use of the road has been <br />as a grove maintenance road. The County has performed some <br />maintenance; however, no maintenance maps have ever been filed for <br />the subject portion. This 25 foot wide portion of right-of-way is <br />not a part of the roadway system as noted on the County Thorough- <br />fare Plan roadway system and is not needed as part of the thor- <br />oughfare system. <br />RECOMMENDATION: <br />Based on the analysis <br />abandon any rights it <br />53rd Street, and that <br />sioners be authorized <br />ment #3), <br />performed, staff recommends that the County <br />may have to this 25 foot wide portion of <br />the Chairman of the Board of County Commis - <br />to execute the attached resolution (Attach- <br />
