The Chairman asked if anyone present wished to be heard. <br />There being none, he declared the public hearing closed. <br />ON MOTION by Commissioner Bowman, SECONDED by Com- <br />missioner Wheeler, the Board unanimously adopted <br />Resolution 87-37 approving the abandonment of any <br />rights the county may have to the subject portion <br />of 53rd Street. <br />RESOLUTION NO. 87 - 37 <br />RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF INDIAN <br />RIVER COUNTY, FLORIDA PROVIDING FOR THE CLOSING, ABANDONMENT, AND <br />VACATION OF A PARCEL OF RIGHT-OF-WAY KNOWN AS 53rd STREET FROM A <br />POINT APPROXIMATELY 21300 FEET EAST OF THE EAST RIGHT-OF-WAY LINE <br />OF U.S. HIGHWAY #1 AND EXTENDING EAST A DISTANCE OF APPROXIMATELY <br />2,650 FEET. <br />WHEREAS, on August 9, 1986, the County received a duly <br />executed and documented petition from Grand Harbor', Inc., 660 <br />Beachland Blvd., Vero Beach, Florida, requesting the County to <br />close, vacate, abandon, and disclaim any right, title, and <br />interest of the County and the public in and to a portion of 53rd <br />Street from a point approximately 2,300 feet east of the east <br />right-of-way line of U.S. Highway #1 and extending east approxi- <br />mately 2,650 feet; and <br />WHEREAS, in accordance with Florida Statutes §336.10, notice <br />of a public hearing to consider said petition has been duly <br />published; and <br />WHEREAS, after consideration of the petition supporting <br />documents, staff investigation and report, and testimony of all <br />those interested and present, the Board finds that said right- <br />of-way is not a state or federal highway, nor located within any <br />municipality, nor is said right-of-way necessary for continuity of <br />the County's street and thoroughfare network, nor access to any <br />given private property. <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA that: <br />1. All right, title and interest of the County and the <br />public in and to that certain right-of-way being known more <br />particularly described as: <br />THE SOUTH 25 FEET OF THE FOLLOWING DESCRIBED PROPERTY: <br />The southeast quarter of the southeast quarter and the <br />southwest quarter of the southeast quarter of Section 14, <br />Township 32S, Range 39E, Indian River County, Florida. <br />is hereby forever closed, abandoned, vacated, surrendered, dis- <br />continued, remised and released. <br />2.
