RESOLUTION NO. 87 - 44 <br />RESOLUTION OF THE BOARD. OF COUNTY COMMISSIONERS OF INDIAN <br />RIVER COUNTY, FLORIDA PROVIDING FOR THE CLOSING, ABANDONMENT; AND <br />VACATION OF A PORTION OF RIGHT-OF-WAY KNOWN AS 19TH AVENUE LYING <br />BETWEEN BLOCK 14 AND BLOCK 13 OF W.E. GEOFFREY SUBDIVISION, <br />RESERVING UNTO THE COUNTY AN EASEMENT FOR DRAINAGE AND UTILITY <br />PURPOSES. <br />WHEREAS, on February 11, 1986, the County received a duly <br />executed and documents petition from James D. Malone, P. O. Box <br />1541, 3716 U.S. 1, Vero Beach, Florida, requesting the County to <br />close, vacate, abandon, and disclaim any right, title, and <br />interest of the County and the public in and to all that portion <br />of 19th Avenue lying between Block 14 and Block 13 of the W.E. <br />Geoffrey subdivision, as recorded in plat book 2, page 32, of the <br />Public Records of St. Lucie County, now lying in Indian River <br />County, Florida; and <br />WHEREAS, in accordance with Florida Statutes §336.10, notice <br />of a public hearing to consider said petition has been duly <br />published; and <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA that: <br />1. All right, title and interest of the County and the <br />public in and to at certain right-of-way being known more <br />particularly described as: <br />All that portion of road rig t -of -way known as 19th <br />Avenue in Section 26, Townsh'p 32S, Range 39E lying <br />south of the south right -of -fay of 37th Place; lying <br />east of the east property lige of lots 184 and 181, <br />Block 13 of W.E. Geoffrey Subdivision as recorded in <br />Plat Book 2, Page 32 of the Public Records of St. Lucie <br />(now, Indian River) County, Florida; lying north of the <br />north right-of-way of 37th Street; and lying west of the <br />west property line of lots 200 and 185, Block 14 of W.E. <br />Geoffrey Subdivision as recorded in Plat Book 2, Page 32 <br />of the Public Records of St. Lucie (now Indian River) <br />County, Florida. <br />is hereby forever closed, abandoned, vacated, surrendered, <br />discontinued, remised and released with the exception that <br />drainage and utility easements on and over the east 20 feet of the <br />parcel described above is hereby reserved in perpetuity unto the <br />County and the public and shall not,be deemed to have been closed <br />or abandoned in any way by this resolution. <br />2. Notice of the adoption of this resolution shall be <br />forthwith published once within thirty (30) days from the date of <br />adoption hereof; and <br />3. The Clerk is hereby directed to record this resolution <br />together with the proofs of publication required by Florida <br />Statutes §336.10 in the Official Record Books of Indian River <br />County without undue delay. <br />4. By the recordation of this resolution in the Official <br />Records of Indian River County, the public is hereby notified that <br />no conveyance of that parcel of land formed by the combination of <br />the east one-half (1/2) of the right-of-way of 19th Avenue, herein <br />abandoned, together with abutting lots 200 and 185, Block 14, W.E. <br />Geoffrey Subdivision, shall be made by Indian River County, the <br />fee simple owner of such combined parcel by virtue of Florida <br />Statute 336.10, without the reservation to Indian River County of <br />utility easements. The location of such reserved utility <br />easements shall be determined by the Indian River County Utility <br />Director after consultation with the City of Vero Beach Power <br />Company and Southern Bell Telephone Company, prior to any such <br />conveyance by Indian River County. <br />53 <br />MAY 51937 <br />BOOK 68 E UE 263 <br />
