He continued that Mr. <br />Malone had a usable piece of property, but with the new zoning <br />and new setbacks, he only has about 198 sq. ft. of buildable <br />area, which they consider an unreasonable use. Abandonment of <br />the R/W will give them about 1400 sq. ft. buildable, and they <br />still will probably need some variances. <br />Commissioner Bowman had a problem, She asked if anyone has <br />considered the need for a frontage road here at some time. <br />Public Works Director Davis stated that would be considered <br />at site plan time. It appeared to him that small triangular area <br />to the east of U.,S.I does have frontage on 37th Place, which is <br />currently open. He further noted that it is a residential area <br />up there. <br />Attorney Collins felt it most likely that someone will pick <br />up the 3 county lots and combine it with this to have a viable <br />piece of property. He emphasized that if the R/W is not <br />abandoned, Mr. Malone would have to apply to have the zoning <br />struck down so he could have a reasonable use of his property. <br />Director Keating noted that staff always looks at frontage <br />or marginal access roads when there is a substantial commercial <br />acreage involved. Right now staff is looking at Geoffrey <br />Subdivision being developed out as residential. <br />It was determined that no one further wished to be heard, <br />and the Chairman declared the public hearing closed. <br />ON MOTION by Commissioner Bird, SECONDED by Com- <br />missioner Wheeler, Commissioner Bowman voting in <br />opposition, the Board by a 4 to 1 vote approved <br />Resolution 87-44, abandoning the county's rights <br />to said 40 foot wide portion of R/W with the <br />exception of the requested utility easement. <br />52 <br />
