PIN <br />DIRECTOR OF UTILIT <br />SUBJECT: CORALSTONE <br />ERVICES <br />BACKGROUND <br />During the process of obtaining the Certificate of Occupancy, <br />Coralstone Development deeded their water lines to Indian River <br />County. Because Coralstone is serviced byNorth Beach Water Company <br />they have a Developers Agreement that requires the lines to be deeded <br />to North Beach Water Company. To prevent Coralstone from a legal <br />battle with North Beach Water Company, I recommend the lines be <br />transferred to North Beach Water Company. Along with the deed it <br />should be clearly understood that when Indian River County takes <br />ownership of North Beach Water Company that the deeded', lines will <br />revert back to Indian River County at no cost as per our franchise <br />agreement with North Beach Water Company. <br />RECOMMENDATION <br />The Utilities Department asks the Board of County Commissioners to <br />authorize the County Attorney's office to prepare the necessary <br />paperwork and deed the lines to North Beach Water Company with the <br />stated understanding. <br />Commissioner Eggert asked what kind of written agreement we <br />have about reversion. <br />Chairman Scurlock explained that we presently are under <br />negotiations with North Beach Water Company. Within their <br />franchise there is an acquisition provision both in the 7th and <br />10th year. It provides for the original cost depreciated 32% up <br />to a maximum of 24%, and that depreciation stops in the 7th year. <br />15 <br />MAY 19 1987 <br />�. at <br />BOOK <br />
