rMAY 19 197 <br />BOOK 68 F GE Jbi <br />"...developments shall not be approved which lower the <br />Level of Service (LOS) on major thoroughfares and/or <br />intersections below LOS C on an average annual basis, or <br />below LOS D during either peak hour or peak season <br />conditions." <br />This ordinance requirement prohibits the facility from <br />locating at the subject site as long as this intersection <br />remains at an inadequate level of service. <br />Currently this intersection is slated for intersection <br />improvements in the 1995-2000 stage of the Long -Range Major <br />Street and Highway Program. The applicant has two alter- <br />natives which would bring the intersection up to an accept- <br />able the level of service prior to occupancy. <br />1. The applicant could petition the County to reprioritize <br />the timing of improvements to the intersection, making <br />the intersection part of the 5 year (near-term) capital <br />improvements program (CIP). In this case, the County <br />would bear the cost of intersection improvements. <br />However, this would not be the most expedient method of <br />providing improvements, since it would take the County <br />approximately two years to study, design and engineer, <br />and construct the intersection improvements. <br />2. The most expedient method would be for the applicant to <br />construct the improvements needed to bring the inter- <br />section up to an acceptable LOS. Currently, more <br />detailed study of the intersection would be needed to <br />determine what improvements are needed to bring the <br />level of service at the intersection up to an acceptable <br />standard. <br />Regardless of how improvements are provided, the use cannot <br />be put into operation until improvements are made to the <br />intersection. <br />Approval of this plan with the condition (no C.O. until <br />improvements are made to the intersection which raise the <br />level of service to an acceptable standard) recommended by <br />staff would provide a private incentive to improve the 8th <br />Street/20th Avenue intersection. This incentive could <br />expedite the improvements to this intersection (e.g. private <br />engineering and design), benefitting the area and general <br />public. If the applicant did not chose to expedite the <br />process they would be effectively prohibited from operating <br />this facility by this recommended condition. <br />6. Off -Street Parking Required: 6 spaces <br />Provided: 6 spaces <br />7. Drainage Plan: The drainage plan has received approval from <br />the Public Works Department. <br />8. Landscape Plan: The proposed landscape plan is in <br />conformance with Ordinance 84-47. <br />9. Utilities: The site will utilize County water and an on-site <br />septic system. The water connection has been approved by the <br />Director of Utilities, and the septic system has been <br />approved by the Environmental Health Department. <br />10.
