Vitunac, County Attorney <br />RE: AGENDA - BCC MEETING 5/19/87 <br />COUNTY ATTORNEY'S MATTERS <br />DISPOSITION OF COUNTY -OWNED LOTS ON <br />FLAMINGO AND EAGLE DRIVES <br />Indian River County and the City of Vero Beach acquired <br />title to many lots in the beach area by tax foreclosures <br />following The Great Depression. Many of these lots were <br />dedicated on October 3, 1944, to various public uses <br />including uses for parks, roads, and utilities.For the <br />last several years, the staffs of the County and the City <br />have been working to straighten out the title to these <br />properties so that the ones which are no longer needed as <br />roads or utilities may be disposed of by the County or City <br />to raise money and to remove a source of liability and <br />maintenance responsibility. <br />Tommy Thomas and I have been in charge of negotiations for <br />the County with the City, and on Tommy's last day of <br />employment with the County the joint staffs unanimously <br />recommended the following disposition of all the properties: <br />(1) The City will quitclaim all its interests in five <br />County -owned lots on the beach which are unencumbered <br />with utilities or road rights of way, and the County <br />will be free then to dispose of these five Tots as it <br />sees fit with the only exception being that the City <br />will retain a five-foot easement for utility service <br />on the lots the same as is common for all lots on the <br />beach area. <br />(2) All other County -owned lots on the beach have <br />been put to public use as either parks, utilities, or <br />roads and will be quitclaimed by the County to the <br />City under an agreement by which the City will attempt <br />to dispose of the usable portion of these lots to <br />adjoining property owners or others at negotiated <br />sales prices. The County will receive 90% of any such <br />sale money with the City retaining 10% for the cost of <br />disposing of the lots. <br />If the County approves of this recommendation, the City of <br />Vero Beach will prepare a quitclaim to the County of all its' <br />interest in the following five referenced lots: <br />Lot 11, Block 7 of VERO BEACH ESTATES <br />Lot 28, Block 7 of VERO BEACH ESTATES <br />Lot 11, Block 8 of VERO BEACH ESTATES <br />Lot 11, Block 9 of VERO BEACH ESTATES <br />Lot 13, Block 18 of VERO BEACH ESTATES <br />The County would then quitclaim to the City all its interest <br />in the approximately 19 other lots comprising Flamingo and <br />Eagle Drives. <br />Attached is a map showing the lots in question which the <br />County will own. <br />63 <br />NAY 19 1987 <br />BOOK i8 OF,F.3SUj <br />
