r__ <br />mAY 2 6 1987 <br />BOOK 8 f'AGE 12d <br />4) This permit recognizes that permits issued by the Florida <br />D.E.R., St. Johns River Water Management District, U.S. Army <br />Corps of Engineers, and Florida D.N.R. contain permit <br />conditions. These conditions shall be monitored for <br />compliance and the developer is subject to State, Federal <br />and Local (ordinance) requirements. <br />5) <br />The cut and fill waiver for the Grand Harbor D.R.I. is <br />limited to 646,000 cubic yards of fill and 320,000 cubic <br />yards of cut. Every six months from the date of issuance of <br />the Land Development Permit until the completion of the <br />^ <br />Phase II earthwork a tabulation of cut and fill quantities <br />shall be submitted to the Public Works Department. <br />6) <br />Clearing of specific building sites shall not commence until <br />the developer is ready to build the building or buildings to <br />be located on the site. [D.O. Condition No. 51 <br />7) <br />During land clearing and site preparation, wetting <br />operations or other soil treatment techniques appropriate <br />for controlling unconfined emissions, including seeding and <br />mulching of disturbed areas, shall be undertaken and <br />implemented by the developer to the satisfaction of the <br />Florida Department of Environmentl Regulation, and in <br />accordance with Indian River County's Tree Protection <br />Ordinance. [D.O. Condition No. 61 <br />8) <br />In the event of discovery of any archaeological artifacts <br />during project construction, the developer shall stop <br />construction in that area and immediately notify the <br />Division of Archives, History and Records Management in the <br />Florida Department of Site. Proper protection of such <br />finding shall be provided by the applicant to the <br />satisfaction of the Division. [D.O. Condition No. 71 <br />9) <br />During construction (including excavation) of the proposed <br />marina basins, estuary/waterways, or surface water <br />management system, soils contaminated with DDT or other <br />restricted agricultural compounds shall be removed and used <br />as fill for the golf course and/or building pads. <br />Deposition of contaminated material on the golf course shall <br />be deposited above the seasonal high water table and covered <br />- <br />with no less than one foot of clean fill -or topsoil. [D.O. <br />Condition No. 91 <br />10) <br />The developer shall coordinate the timing of his construct- <br />ion schedule such that immediately prior to the period when <br />conection of waterways on-site to the existing basin or to <br />the Indian River Lagoon takes place, pumping of water to <br />lower the water table on-site shall cease. No pumping shall <br />take place after the connection is made. [D.O. Condition No. <br />12] <br />11) In the event that it is determined that any representative <br />of a plant or animal species designated as endangered or <br />threatened on Federal, State of Florida, or Florida <br />Committee on Rare and Endangered Plants and Animals lists is <br />resident on, or otherwise is significantly dependent upon <br />the Grand Harbor property, the developer shall cease all <br />42 <br />
