Reference has been made to a <br />Motion made not to acquire, and now the county want to take, and <br />that is not going to happen. <br />Attorney Sundstrom then reviewed the history of the situa- <br />tion, noting that when Florida Land, the parent corporation of <br />Bent Pine, sold most of the ground that compromises Hawk's Nest <br />development, there was an agreement that property would become <br />part of the Bent Pine service area. County staff was approached <br />about their serving Hawk's Nest, and they said only if you agree <br />in advance to give us your property for no consideration. <br />Chairman Scurlock noted we are not talking about an expan- <br />sion of franchise today; that was not advertised; and Attorney <br />Sundstrom replied that he is talking about a recommendation by <br />county staff that Bent Pine be given an opportunity to come and <br />speak to the Board. He noted that his client does not have <br />"horns and tails" but they have 1.2 million invested in some <br />property, and they are trying to protect it. <br />Attorney Sundstrom continued that his client is not a litig- <br />ious kind of client and they don't like doing this, but they have <br />got themselves in a heck of a mess. The County Commission has <br />been sued for injunction to stop the closing of the bond issue to <br />service Gifford. A declaratory statement action has been filed <br />in Circuit Court to see what their rights and responsibilities <br />are. That's what Chapter 86 is.all about. Apparently, there are <br />some people in this room who seem to believe that his client has <br />some obligation to come to the Commission hat -in -hand and taken <br />whatever is given them, and that is not an act of regulation; <br />that is an act of taking. And the matter is worse than that <br />because the county has said we are going to own and control all <br />the utilities in the county. Many of the counties have done <br />that, and that is fine. Go ahead. We really don't want to be in <br />your way. However, he believed the County is going to spend <br />50 <br />
