$150,000 defending the first Division of Administrative hearings; <br />and probably spending another such amount defending the second. <br />The county has just filed a lawsuit against Bent Pine in the St. <br />John's River Water Management District to stop them from building <br />a well which his client says it needs to build in order to <br />provide service to the people at Bent Pine. Now we have Circuit <br />Court litigation going on, and the lawyers are going to make a <br />lot of money, and that's silly. Attorney Sundstrom stressed that <br />Bent Pine is regulated by the DER, regulated by St. John's, <br />regulated by good business practice, and the county should let <br />them serve Hawk's Nest and let them alone. <br />Chairman Scurlock inquired where the Commission has ever <br />denied Bent Pine anything. <br />Attorney Sundstrom stated that his client applied to this <br />Commission through its staff for authority to extend that service <br />area geographically in order to provide service and carry out its <br />contractual conditions with Hawk's Nest - a property right - and <br />his client was advised there was no way that matter would ever <br />get before this Board unless they agreed to accept a franchise <br />that was unacceptable. <br />Chairman Scurlock asked the Commission's Administrative <br />Assistant, Mrs. Forlani, if anyone has ever, for any reason, been <br />denied the opportunity to be placed on the Commission agenda, and <br />Mrs. Forlani confirmed that no one ever has. <br />The Chairman asked Mr. Sundstrom if he had ever talked to <br />Administrator Balczun to appeal Director Pinto's decision or ever <br />asked Mrs. Forlani to go ahead and schedule them for an appear- <br />ance before the full Board of Commissioners. <br />Attorney Sundstrom stated that he was not aware of that ever <br />taking place. <br />Chairman Scurlock asked if Attorney Sundstrom was aware of <br />administrative procedure, and Attorney Sundstrom noted that it is <br />a matter of law that you don't have to proceed and follow a <br />futile effort. <br />► L 1 . 51 BOOK 68 F-, , O3 <br />
