years. There has been no talk of "taking" the system. He <br />believed we are prepared to give Bent Pine the new franchise <br />today and wished to know if they will operate according to the <br />franchise after that and live up to the terms of the '79 <br />franchise by September of 1987. <br />Attorney Sundstrom felt in all fairness his client needs to <br />talk to its various consultants and determine what is in their <br />best interests. One of the provisions of the franchise was a <br />condition that kind of said if the county wanted to acquire at <br />the end of the term, it could and not have to pay for the fair <br />market value of all the pipes in the ground and certain related <br />appurtenances. He believed that provision is now out the window <br />and accepting the franchise could represent giving away $600- <br />$800,000 worth of pipes which might not be too smart. <br />Attorney Vitunac asked if Attorney Sundstrom believed the <br />company is under an obligation to accept the 179 franchise. <br />Attorney Sundstrom did not know. <br />Commissioner Bird again stressed that he liked the "roll up <br />the sleeves and get down to the basics" approach. This is a <br />monster that is growing daily; he would like to see the situation <br />diffused and felt we should allow some time to table the matter. <br />Commissioner Wheeler was not in favor of tabling. He noted <br />that we keep hearing from their counsel that they do not know <br />that we have the ability to have a franchise, and he felt that is <br />something that can only be answered in court. <br />Attorney Sundstrom felt Commissioner Bird's comment is well <br />taken. Here we have two tough protagonists, and (are stalemated) <br />unless we can roll up sleeves and work for everyone's best <br />interests. He felt actually the ultimate mutual best interest <br />probably is for Florida Land to save face and leave Indian River <br />County with good grace, but he felt even if they went in that <br />way, there would be further fights. <br />Commissioner Bird continued to urge working together to come <br />L ,14 198 61 soon � �acr 81 <br />
