i <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Wheeler, the Board unanimously accepted <br />the only bid, Suburban Carting, Inc., in the amount <br />of $6100 for the 40 yd. containers. <br />PURCHASE AGREEMENT WITH STATE FOR HOWELL-CHAPMAN ACQUISITION <br />The Board reviewed the following memo dated 7/20/87: <br />TO: The Board of C unty Commissioners <br />THROUGH: Charles itunac County Attorney <br />DATE: July -.20, 1987 <br />SUBJECT: Save Our Coast Howell -Chapman Acquisition <br />FROM: Bruce Barket - Assistant County Attorney <br />On or about August 11: a trial is scheduled for a jury to <br />determine what price must be paid to acquire the <br />Howell -Chapman parcel in eminent domain proceedings. The <br />Board of Trustees of .the Internal Improvement Trust Fund, <br />through the Save Our Coast program, is contributing <br />$2,490,683.00 toward purchase of the parcel. In return, the <br />Trustees require title to the property, which will then be <br />leased back to the County for.maintenance and operation as a <br />public recreational area. <br />A copy of the purchase agreement between the County and the <br />Board of Trustees is attached for your review and approval. <br />The agreement provides for conveyance of title to the <br />subject property to the Trustees for $2,490,683.00, <br />regardless of the condemnation price the County is required <br />to pay. However, in.return for the County's contribution, <br />the agreement also provides that the property shall be <br />leased back to the County for public recreational use <br />pursuant to a lease agreement which shall not be for less <br />than 30 years. We will have a closing in escrow, and final <br />closing will be conditioned upon a successful completion of <br />the County's eminent domain case. That way, if we -acquire <br />the property by settlement or by trial, we can complete the <br />transaction with the State. If, for any unforeseen reason, <br />the eminent domain action fails, or the jury returns a price <br />higher than the County is wi l 1 ing to pay, then the State's <br />money will be returned. <br />It is recommended that the Board of County Commissioners <br />authorize the Chairman to execute the attached Purchase <br />Agreement with the State. <br />Assistant County Attorney Bruce Barkett explained that this <br />matter was added to today's Agenda as an emergency item because <br />the agreement must be mailed to Tallahassee this morning.
