i <br />RECOMMENDATION <br />Staff recommends that the Board of County Commissioners adopt <br />alternative three as a method of legalizing all existing home <br />occupations within the Rose -4 District in order to ensure that all <br />existing home occupations will not adversely affect the <br />residential nature of the community. <br />Commissioner Eggert pointed out that the intent of the <br />Motion at the meeting of February 24, 1987 was to direct staff to <br />find a way to legally grandfather in the existing businesses. <br />Chairman Scurlock asked if there actually were 43 businesses <br />in operation, and Staff Planner David Nearing said that they <br />found only 6, and since that time, two of them have said that - <br />they would not be continuing their operation. <br />Mr. DeJoia, President of Roseland Property Owners <br />Association, stated that the residents in the area are concerned <br />that when the downzoning occurred, there was an expansion of <br />allowable home occupation uses. He admitted that they did not <br />attend the last public hearing, but after they heard what <br />happened, they called a general meeting with Commissioner Bowman <br />and Director Keating, and the recommendation to come out of that <br />meeting was that something be done to eliminate these home <br />occupations such as metal equipment and manufacturing. He felt <br />some consideration should be given to the businesses that are <br />already there, and if they are grandfathered in, perhaps some <br />consideration should be given to setting up a low intensity <br />commercial zoning district. The Association does not want to see <br />any more businesses grandfathered into the ROSE -4 district. They <br />feel that to expand the home occupations is really junk zoning, <br />and they don't like it. <br />Attorney Vitunac advised that he was unable to carry out the <br />intent of the Motion during that meeting because staff was able <br />to identify only 6 businesses, not the alleged 43, as the other <br />people are not coming forward, and he cannot write an ordinance <br />legalizing all those unknown businesses. <br />Commissioner Wheeler felt the facts have changed since the <br />last meeting or as the Board perceived them to be at that time. <br />47 <br />JUL 2 1 BOOK <br />198 <br />
