r <br />2. A 5' wide pedestrian path system is proposed in lieu of <br />sidewalks lining both sides of all streets, as is normally <br />,required by the subdivision ordinance. <br />3. For the interior corner lots, a 20' setback is to apply to <br />one of the front yards; a 15' setback will apply to the other <br />front yard. <br />4. jFor the interior lots, where rear yards abut common open <br />(space areas, swimming pools may be located within 5' of rear <br />',property lines. <br />Staff has no objection to these waivers.. <br />RECOMMENDATION: <br />Staff recommends that the Board of County Commissioners approve <br />the PRD special exception use and conceptual plan with the fol- <br />lowing conditions: <br />1. that prior to any preliminary PRD plan approval, the <br />developer work-out an agreement with the Public Works <br />department providing for upgrading (to County standards) the <br />site's frontage on 5th Avenue S.E.; and <br />2. that the normal RS -6 setbacks be applied to all lots fronting <br />on the 5th Avenue S.E.- right-of-way adjacent to the Vero. <br />Shores subdivision. <br />Chairman Scurlock opened the Public Hearing and asked if <br />anyone wished to be heard in this matter. <br />John Ehrmantraut, 1934 5th Court, explained that there is a <br />culvert that runs from 5th Avenue, S.E. underneath 5th Court and <br />intolthe canal behind his home. There is also a drainage ditch <br />that abuts the southern end of the property, and he wished to <br />know 'what they plan to do with that. The canal fills up badly <br />whey, the culvert empties into the canal. <br />Commissioner Wheeler recalled that a letter was written to <br />Public Works sometime ago regarding this culvert, and Public <br />Works Director Jim Davis explained that he has been in - <br />communication with the DOT regarding this situation, and the DOT <br />has <br />the c <br />requi <br />to tt <br />that <br />dvised that they have released the minority contractor from <br />:ontract on this culvert as he has satisfied all the <br />rements.
