this project and also since this process started back in August, <br />1983, which is just about when our transition and our new <br />ordinance took place. The adjacent piece of property does have <br />access onto 12th Street, and he believed the hardship there was <br />not really self-created. While he fully respected staff's <br />feelings, he felt that we should give some consideration to this <br />matter. <br />Commissioner Bird felt that while the hardship may have been <br />self-created, it was not intentional.. <br />Chairman Scurlock opened the Public Hearing, and asked if <br />anyone wished to be heard in this matter. <br />Attorney Samuel Block, representing the Warren's, gave a <br />brief history of the subject property, explaining that the Warren <br />family has owned and lived on the property fronting on lith Place <br />since 1964. They sold the property once in 1977 or 1978, but had <br />to take the property back because easements cannot be obtained on <br />either side of it. Their family grew up and they went to some <br />professionals and got this configuration in 1983. In 1984 they <br />sold the back part of the property and they were planning to put <br />a culvert up there, build on one site and leave the other lot <br />there. Attorney Block emphasized that they followed normal <br />procedures and got a permit from the Indian River Farms Drainage <br />District before finding out that they couldn't access 12th <br />Street. They did not do this intentionally. They did make it so <br />that they don't have access to 11th Place, but they didn't do it <br />on purpose. They just cannot build on that piece of property. <br />What we are talking about is two lots with one culvert with one <br />turn -around drive, and all his clients are asking is to be <br />allowed to build a culvert and put their driveway on 12th Street <br />so that they can build a home there. Attorney Block entered into <br />the record a statement signed by 15 of the Warrens' neighbors <br />saying that they have no objection to a culvert being constructed <br />on 12th Street. (Statement is on file in the Office of the Clerk <br />to -the Board.) <br />25 <br />
