(Commissioner Eggert understood that the access right-of-way <br />to this property was sold, and Attorney Block stated that was not <br />really correct. He admitted it is rather confusing, and pointed <br />out the improvements on that property run 10 feet to the left and <br />there is no way they could get an easement there. All of that <br />property is improved and has been since 1964. It is not as if <br />they !,are trying to do it again and make more profit. They h e <br />lived in that house for more than 20 years. <br />There being no others who wished to be heard, the Chairman <br />closeld the Public Hearing. - <br />MOTION WAS MADE by Commissioner Wheeler, SECONDED by <br />Commissioner Bird, that the Board grant a variance to <br />the Subdivision Ordinance (Ord. 83-24) to allow access <br />onto 12th Street, with the condition that one driveway <br />will serve both lots. <br />Director Keating recommended that the Board formalize the <br />process by requiring a limited access easement for the northern <br />boundary on each of those lots where they abut the canal south of <br />12thiStreet. That requirement will give notice to any future <br />residents that there will be no other curb cuts there and that <br />the driveway will be used by two residences; the requirement <br />should also specify maintenance responsibilities. <br />Commissioners Wheeler and Bird agreed to add the above <br />conditions to their Motion. <br />THE CHAIRMAN CALLED FOR THE QUESTION. The amended <br />Motion was voted on and carried unanimously. <br />Director Keating advised that Indian River Farm Drainage <br />Dist ict has agreed not to issue culvert permits on canals such <br />as this before checking with County Engineering regarding the <br />righ -of-way. <br />l <br />26 � 6,.'9 Wfi.155 <br />
