He advised that <br />he h s paid all those charges, and believes they have approxi- <br />matel!y $4000 of his money that they are not entitled to. He has <br />asked them to reimburse him that amount, but they have not. Mr. <br />Kohler asked the Board's help in this matter. Mr. Kohler hoped <br />the CIounty would take over the franchise and give the area the <br />same good service that they have given the rest of the county. <br />There being no others who wished to be heard, Chairman <br />Scurlock closed the Public Hearing. <br />(Chairman Scurlock asked if anything had been discussed about <br />the $4,000, and Director Pinto explained that was the subject of <br />the last public hearing, and as far as the County is concerned, <br />BentlPines was not permitted to collect those monies. <br />ris Bentley, Attorney representing Bent Pines, felt there <br />is some disagreement as to what the law is and what the utility <br />I <br />is ah owed to do with the monies it has collected. He advised <br />thatlthose monies are in an interest-bearing escrow account, but <br />under the terms of that escrow account, those people will receive <br />that,money at the end of the taxable year. The utility feels it <br />has he right to collect those fees up front and place it in an <br />escriw account. <br />Attorney Vitunac advised that was one of the problems that <br />was resolved by the County purchasing the utility company. If <br />Mr. Kohler does not want to accept that, he will have to take <br />private legal action against the old franchise. <br />Mr. Kohler asked if the reimbursement would be an automatic <br />thin and Mr. Bentley confirmed that it would be automatic <br />unless certain taxable events occur. In other words, if this <br />purc'ase goes through, there will no longer be any taxable events <br />on t e part of Bent Pines Utility, and the monies would be <br />returned.
