su <br />AUTHORIZATION FOR CLOSING WITH BENT PINE UTILITY <br />Attorney Vitunac informed the Board that Bent Pine wants to <br />see the cash in escrow before they will move to get the lawsuit <br />: dropped on the permit protest; so, we have been on the phone <br />since Saturday. The plan is that Bent Pine will come in <br />tomorrow, and we will have a mini -closing in escrow with an <br />escrow agreement. He, therefore, would like authority to give a <br />$270,000 check to their escrow account. The letters of apology <br />will be signed and delivered to him. <br />Commissioner Eggert asked if the letters of apology are <br />going to be read in open Commission meeting? <br />Chairman Scurlock commented that he is both disheartened and <br />aggravated by the editorial in the paper this morning, which he <br />thought missed the whole point. Mr. Pinto and he, at great <br />pressure to their families, have decided to settle; this <br />Commission has formally taken and made Motions and approved <br />entering into this agreement; and yet this group now is insisting <br />on having cash in escrow before they move again, which he felt <br />demonstrates their entire attitude through this whole process. <br />The Chairman emphasized that the whole point is that Bent Pine <br />Utility sat here and abused the process, abused the citizens of <br />Indian River County - the Gifford community almost lost their <br />entire project, the Grand Harbor project could easily have been <br />scuttled, and these were all side issues. None of it had to do <br />with the real issue of acquisition of that utility when it came <br />right down to it, and he felt the Press was irresponsible and <br />that article "stunk." <br />Attorney Vitunac advised that he needs authority to go ahead <br />and sign some of these interim documents and proceed with the <br />mini -closing, and then we will push for the main closing as soon <br />as possible, probably in about three weeks. <br />OMB Director Baird stated that, in order to avoid any <br />problem with the auditors, he would like authorization in the <br />record to pay these monies out of the Utility Impact Fee funds . <br />42 <br />
