Kba1lingCMICP SUBJECT: <br />Planning & Development Director <br />GRAND HARBOR, INC.'S _- <br />PETITION TO ABANDON A <br />PORTION OF GIFFORD DOCK = -_ <br />ROAD <br />FROM: Stan Boling A6, :.REFERENCES: <br />grand-harbor- <br />Chief, <br />randk!arbor- <br />Chief, Current Development STAN4 <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at their <br />regular meeting of September 22, 1987. <br />LOCATION AND DESCRIPTION: <br />Grand Harbor, Inc. has submitted a petition to abandon a ±1,284' <br />portion of Gifford Dock Road. The subject right-of-way segment <br />lies approximately 4,900' east of U.S. 1 along 45th Street, <br />"cutting across" the southeast corner of the Grand Harbor site. <br />Along with the abandonment petition, the applicant proposes <br />dedication of an alternate Gifford Dock Road routed around the <br />southeast corner of the Grand Harbor project. In essence, the <br />applicant is proposing that the County abandon a segment of <br />Gifford Dock Road in exchange for a relocation of the road, <br />including right-of-way dedication for the new route and <br />construction of a new marl road. The proposed road relocation <br />would provide the same quality of access from 45th Street to the <br />river that is provided by the road segment to be abandoned. <br />Abandonment of this portion of Gifford Dock -Road would permit the <br />creation/restoration of the southernmost estuarine area, pursuant <br />to the approved Grand Harbor estuarine plan. <br />To ensure that the new roadway alignment will be dedicated and <br />constructed prior to the removal of the segment to be abandoned, <br />the applicant and the County Attorney's office have worked out the <br />following arrangement: <br />1. County abandons the subject road segment; <br />2. Grand Harbor, Inc. conveys by deed to the County, the segment <br />abandoned by the County. The deed (see attachment #4) <br />contains a reverter clause which states that the roadway <br />segment (to be abandoned by the County) will revert to Grand <br />Harbor, Inc. when the new road segment is constructed and <br />dedicated, and approved by the Public Works Director. <br />Therefore, although the County will abandon the subject road <br />segment, that segment will not revert to Grand Harbor, Inc. until <br />the new roadway is dedicated andsâ–șconstructed. <br />45 <br />SEP 22 1987 - BOOK 69 FACE 529 <br />
