M <br />1.. Within three business days, including today, Friday, <br />October 2, 1987, (telephone notice having been given to the <br />county attorney this morning of this order) this order shall take <br />effect unless the population of the jail is in compliance with <br />the 143 -capacity. _ <br />2. .Thi/sfi:l'order -does not affect the release of any person,. _ <br />who, in the opinion of the staff at the Indian River County <br />Sheriff's Correction Division reasonably appears to present a <br />potential danger to the physical safety';8-f others or the inmate's <br />safety. <br />3. All misdemeanants sentenced to the Indian River County <br />Jail shall be released on reporting Probation for the length of <br />their remaining sentence,' except those serving mandatory jail <br />time. <br />4. All misdemeanants awaiting trial, who reside in Indian <br />River County, shall be released on their own recognizance (ROR) <br />except those Indian River County misdemeanants charged with DWI <br />or DUI who shall be held pursuant to Indian River County <br />bond schedule for three days and, if not, released ROR. <br />This order shall continue to be in effect as long as the <br />population of the Indian River County Jail is in excess of 143 <br />inmates or until further order of this court. <br />DONE AND ORDERED in Vero Beach, Indian River County, Florida <br />this ay of October, 1987. <br />JAIL OV T OMM TEE <br />By <br />C a 1 s E. mith, ircuit Judge <br />By to Lt <br />ry Whitton, Indian River <br />Count ublic Defender's Office <br />Attorney Barkett advised that we have to transmit this order <br />to the Sheriff, and in the meantime we can either approve the <br />contract with Okeechobee for transfer of prisoners, go back to <br />the Jail Oversight Committee, take an interlocutory appeal, or a <br />61 <br />CT r - boots 69 PA6E U:3 <br />
