OCT 13 1987 BOOK 69 PAGE 668 <br />consultant look not only at the needs study that is asked for <br />under the franchise, but also look at our system of collection to <br />determine whether we should regulate commercial, whether we <br />should have districts, and whether or not we should have <br />mandatory collection, then staff would set their recommendation <br />aside and agree we should have that kind of study. <br />Commissioner Eggert noted that she is not speaking pro or <br />con in terms of the applicants; she just feels that right now the <br />picture is foggy and was not sure it is fair to anyone to do <br />anything now when we are within a month or six weeks of getting <br />some of these things straightened out. She felt possibly we <br />would be better off tabling these applications until we have had <br />the study. <br />Commissioner Wheeler understood we have two franchises <br />countywide at this time and asked if they specifically exclude <br />commercial or do they specifically point out that the franchise <br />is only for residential. <br />Director Pinto explained that the franchises specifically <br />say that the commercial rates are unregulated. <br />Commissioner Wheeler felt the needs study would need to be <br />done for either, and Director Pinto agreed if we are going to do <br />the study, we should do it 100%. <br />Chairman Scurlock noted that actually this is a very complex <br />subject. He was not even sure we have the unilateral ability to <br />set up districts; possibly we do, but he believed there might <br />have to be some negotiation with the two existing valid <br />franchises. He did believe it would be inappropriate for us to <br />direct each of these applicants to go out and do a needs study, <br />and ^felt the residential should stay status quo until we do a <br />study. He noted that Director Pinto obviously feels strongly <br />that commercial should be unregulated and doesn't have a problem <br />with additional franchises, and if the majority of the Board <br />feels that is all right, we could issue franchises for commercial <br />and leave the other in abeyance. <br />26 <br />_ M M <br />v <br />
