r <br />OCT 2 7.1987 BOOK 69 rn 80 3 <br />moved there. There is no date for services, and environmental <br />concerns have always been an issue of the Commission. Mr. Block <br />pointed out that the Board used their discretion when looking at <br />the 16th St. (Rosewood) area and considered the character of the <br />neighborhood, and he felt this should be looked at in the same <br />light. On behalf of the Winter Beach Progressive League, he <br />asked that the Board do what the neighborhood calls for and <br />approve LD -1 and RS -3 as set out in the Small Area Plan. <br />Attorney Ted Herzog, appeared representing LaRue Equities, <br />owner of approximately 102 acres of the 145 being discussed <br />today. He believed there are two.special interest groups here <br />today, each trying to focus the Board's concern on specific <br />issues, but he felt no matter how you cut it, the overall concern <br />is good planning. Mr. Herzog then referred to the map being <br />displayed, noting that generally speaking along the whole linear <br />corridor, the Comprehensive Plan has historically related to a <br />density of 6. We now have a piece of property described as the <br />subject property, 2/3s of which is owned by his clients, and <br />right above them is a peninsula of 3 upa sticking out into the <br />more or less 6 upa zone. That peninsula is a zoning anomaly <br />established by the Board, and it is a poor reason for perpetua- <br />ting the bad zoning policy previously enacted by this Commission. <br />The P&Z staff consistently has asked for 6 upa. Many of the <br />arguments the Board has heard have been environmental in nature, <br />but Mr. Herzog believed that virtually any development will <br />affect the habitat and the wildlife; so, he did not feel that is <br />a valid concern. This happens to be about the only area of the <br />ridge that has not been mined, and he felt it is again an anomaly <br />that the Board would focus the restrictive zoning in the one area <br />where the mining hasn't been complete. Mr. Herzog noted that <br />since the last time they were here, there has been one signifi- <br />cant change in the area - the Treasure Ridge property which was <br />granted RM -6. The only difference in that area is that the trees <br />and the sand are gone, which would lead one to conclude that the <br />60 <br />
