In 1986, the State Legislature revised the local government <br />Comprehensive Plan amendment procedure. The process now requires <br />the first public hearing by the Board of County Commissioners to <br />be held prior to the transmittal of each request to the State <br />Department of Community Affairs (DCA) for a mandatory ninety -day <br />review period. At that public hearing, the Board has the <br />option of transmitting or not transmitting any or all of the <br />proposed amendments to the State for review. Failure to <br />authorize transmittal of any proposed amendment constitutes <br />denial of that request; however, transmittal of an application <br />does not indicate Board approval of the request. <br />After all the comments from DCA are received, the Board of County <br />Commissioners will schedule a final public hearing to consider <br />the proposed amendments. At the close of the final hearing, the <br />Board may adopt all, part of, or none of the proposed amendments <br />to the Comprehensive Plan. The attached flow chart illustrates <br />the Comprehensive Plan Amendment process as amended by the 1986 <br />state planning legislation. <br />It is necessary for the Board of vote on each of the <br />Comprehensive Plan amendment applications in order to authorize <br />transmittal of the applications to the State for review. Three <br />affirmative votes are required to authorize transmittal. <br />Further, it is necessary for the Board to state their intent to <br />hold a second public hearing concerning those amendment requests <br />authorized for transmittal. <br />ALTERNATIVES & ANALYSIS <br />The Planning Department feels that the best way to authorize the <br />transmittal of the proposed Comprehensive Plan amendments to the <br />state for review is through the passage of a resolution <br />authorizing the transmittal. Since a second public hearing must <br />be held prior to action being taken on each of the amendment <br />applications, no final decision can be made on;the applications <br />at this time. However, action is needed on the attached <br />resolution in order to comply with the plan amendment procedure. <br />RECOMMENDATION <br />Based on the above analysis, staff recommends approval of the <br />attached transmittal resolution. <br />ON MOTION by Commissioner Eggert, SECONDED by Comnis- <br />sioner Bowman, the Board unanimously adopted Resolu- <br />tion 87-129 authorizing transmittal of those Comprehen- <br />sive Plan amendments approved today for transmittal. <br />OCT ?'t" 1987 67 840 <br />n <br />ROOK 69 �'.�;F 840 <br />
