TO LEASE COUNTY RIGHT- <br />OF-WAY <br />FROM: Charles P. Bal czun REFERENCES: <br />County Administrator <br />Qnrvr_oniimn <br />Albamar, Inc. wishes to lease a 1 foot by 60 foot strip of County right-of- <br />way on 14th Avenue at Marian Plaza on which an advertising sign would be <br />constructed. This request is made because our existing right-of-way is 200 <br />ft. wide thereby causing signage to be nearly 65 feet from the roadway. <br />ANALYSIS <br />Our right-of-way at this location is unusually wide and we have no current <br />plans for improvements which would be impaired if we grant the request. <br />The Department of Community Development by memorandum dated October 14, <br />1987 recommends against such a lease while the Department of Public Works, <br />by memorandum dated October 14, 1987 makes a favorable recommendation. <br />Following my review of the two staff reports, I directed that a licensing <br />agreement be drafted by which the County would grant to Albamar, Inc. a <br />license to use the 1 ft. by 60 ft. strip. <br />RECOMMENDATION <br />I concur with <br />the <br />position <br />taken by the Department of Public Works and <br />recommend that <br />the <br />Board of <br />County Commissioners authorize the Chairman to <br />execute such an <br />agreement with Albamar, Inc. <br />Our best estimate <br />of the <br />reasonable value of the property approximates <br />some $300/yr. <br />The proposed <br />agreement is <br />for a term of five years, requires that the <br />property be used in <br />a lawful <br />manner only and provides for revocation by the <br />County upon 90 <br />days <br />notice and <br />by the Licensee upon 30 days notice. <br />Commissioner Eggert was concerned about leasing R/W to a <br />business for a term of five years with no option to renew or any <br />other such provision, and wondered why there was not such an <br />option. <br />Administrator Balczun advised that Public Works Director <br />Davis developed this agreement based upon what, to his knowledge, <br />is the only prior agreement of this kind approved by the Board, <br />and he believed this is almost a replication of that document. <br />The Administrator merely thought five years was a reasonable <br />10 <br />V <br />
