REMS <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at their <br />regular meeting of December 8, 1987. <br />DESCRIPTION AND CONDITIONS: <br />The County has been petitioned by James and Elizabeth Callahan, <br />owners of the subject property, for the release of the southerly <br />three (3) feet of the northerly ten (10) foot utility easement, <br />being the southerly three (3) feet of the northerly ten (10) feet <br />of Lot 21 Block E, Seagrove Subdivision Unit 6, Section 16, <br />Township 33 South, Range 40 East, .Indian River County, Florida; <br />according to the Plat thereof as recorded in the official Record <br />Book 636 Page 1193. It is Mr. & Mrs. Callahan's intention to <br />effect compliance with Indian River County regulations by <br />releasing that part of the utility easement which the enclosed <br />pool deck has been encroaching since 1982. <br />The current zoning classification is RS -3, Single -Family <br />Residential District. The land use designation is LD -1, Low <br />Density Residential up to three (3) units per acre. <br />ALTERNATIVES AND ANALYSIS: <br />The request has been reviewed by Southern Bell- Telephone, Vero <br />Beach Power Company, Florida Cablevision Corporation, and -the <br />Indian River County Utility and Right -of -Way Departments. Based <br />upon their review, there were no objections to the release of that <br />portion of the ten (10) foot utility easement. The zoning staff <br />analysis showed that the drainage would be adequately handled on <br />the site. <br />RECOMMENDATION: <br />Staff recommends to the Board, through the adoption of a <br />resolution, the release of the southerly three (3) feet of the <br />northerly ten (10) foot utility easement of Lot 21, Block E, <br />Seagrove Subdivision, Unit 6, as recorded in Plat Book 10 Page 94, <br />of the.Public Records of Indian River County. <br />4 <br />
