I <br />E Q <br />1987 <br />BOOR <br />70 F-A� 315: <br />The Chairman had a question about <br />limiting it to <br />an equity <br />situation and asked if that is not an ownership question rather <br />than a land use question. <br />County Attorney Vitunac agreed and explained that it also <br />goes into the definition of what a beach.club is. The problems. <br />we are trying to solve are use related, and he did not see the <br />relationship between equity ownership and the problem. <br />Commissioner Wheeler stressed that his concern is opening <br />the door a little bit further and where do you draw the line on <br />potential future commercial ventures. <br />Chairman Scurlock pointed out that where you draw the line <br />is that this project has adjacent developable land, and Commis- <br />sioner Eggert also noted that we have the added fact that this is <br />a special exception and we look at each one individually. <br />Attorney Vitunac advised that if you really want to look at <br />this issue, it would be appropriate to have an expansion of the <br />Zoning Code ordinance on beach clubs, and put out some of these <br />concerns in ordinance form; then, in the future, your enforcement <br />mechanism would be the Code Enforcement Board. He noted, <br />however, that right now the Code Enforcement Board still can <br />enforce what a beach club is if this should change to something <br />Director Keating's people feel is not a legitimate beach club. <br />Director Keating stressed that we do have a definition of <br />country club and it does reference members and membership fees, <br />and also during the special exception process you have the <br />ability to more specifically qualify those characteristics. <br />The Chairman asked if anyone present wished to be heard. <br />Attorney Michael O'Haire came before the Board representing <br />the Sea Oaks Property Owners Association. He stated that he is <br />here not necessarily to speak in opposition, but to suggest some <br />things of a legal nature. Mr. O'Haire noted there are no <br />standards in the Special Exception, and Attorney Vitunac has <br />indicated an amendment to the ordinance probably would be <br />required.
