M <br />which is in progress would severely inhibit any development since <br />flood insurance would not be available north of 510 because <br />utility services are not available, and he had not considered <br />these factors when he had suggested possibly locating the <br />facility next to a park which would be a great buffer. <br />Commissioner Bird felt that, in addition to the conditions <br />listed by staff, there should be an additional condition to help <br />satisfy the concerns of those who fear that in the future this <br />facility might be converted into a private commercial venture, <br />and he would like to include some language to guaranty -that the <br />beach club will remain in the future what it is proposed to be <br />today. He has discussed this with Director Keating. <br />Planning Director Keating pointed out that, first of all, if <br />the club changed characteristics at all, it would have to come <br />back through and get another type approval. However, to <br />accomplish what Commissioner Bird is talking about, language <br />could be added, i.e., "that the applicant through a set of <br />recorded and county approved membership documents will provide <br />evidence that transient use of club facilities will not occur, <br />such evidence may include but not be limited to price of the <br />membership, residential membership qualifications, membership <br />time frames, and other requirements." He felt that condition <br />puts the burden on the applicant for coming up with the criteria. <br />Chairman Scurlock believed all the Comm!-ssioners have been <br />concerned about a potential commercial nature. As to increased <br />traffic on A -1-A, however, he pointed out that there are 87,000 <br />people in the county who have a right to use A -1-A whether they <br />go to a beach club or not. He agreed we do not want someone <br />.building a "Lobster Shanty," and selling $10 memberships, but <br />that is not what is happening here. <br />Commissioner Wheeler emphasized that he would like to see it <br />made clear that it is a limited membership - that it is an equity <br />type and truly private club and ultimately the Board of Directors <br />will be the owners of the club.' <br />67 <br />Bou 70 <br />A <br />
