Vitunac, County Attorney <br />DATE: December 10, 1987 <br />RE: EMS ORDINANCE <br />BOARD MEETING 12/22/87 <br />The attached EMS ordinance has been properly advertised and <br />1s being presented to the Board for final adoption. The <br />reason for the adoption of this ordinance is a recent change <br />in Florida law. The law now requires that Certificates of <br />Public Convenience and Necessity, granted by the County to <br />applicants who desire to provide emergency medical service <br />in the county, be based upon reasonable standards adopted by <br />the County by ordinance. <br />The attached ordinance has been through a lengthy review <br />process with the emergency services community, which <br />includes the fire departments, ambulances, hospitals, <br />police, and sheriff's department. While the recommendation <br />of the advisory committee was not unanimous, the majority of <br />the committee members felt that the adoption of this <br />ordinance would provide the county with a reasonable <br />framework for improving the public health, safety, and <br />welfare. The ordinance tries not to duplicate any <br />regulation already performed by the State of Florida, <br />through the Department of Health and Rehabilitative <br />Services. The various aspects covered by the ordinance were <br />suggested by the State as areas which deserve local <br />attention. <br />Failure to adopt an EMS ordinance will result in the <br />regulation of ambulances being entirely at the State level. <br />Attorney Vitunac reported that the EMS Committee has spent a <br />considerable amount of time working with the service providers <br />and drafting the proposed ordinance, which includes such things <br />as mandatory minimum response times, method by which the Board <br />would handle and review complaints, etc. <br />The Chairman asked if anyone present wished to be heard. <br />Duncan Chalmers, 1926 34th Ave., came before the Board <br />representing the Emergency Services Coordinating Committee for <br />Fellsmere services. He believed that most are aware that the <br />Board of Directors of the Fellsmere squad originally vigorously <br />opposed the ordinance; however, with the changes that have been <br />made since then, they are now in favor of it.
