The Board reviewed memo from the County Attorney: <br />TO: Board of County Commissioners <br />FROM: Ch::a_rPT%'Y(201!�d fr ttfn c�nty At t o r n e y <br />DATE: December 16, 1987 <br />RE: SOLID WASTE DISPOSAL DISTRICT <br />PUBLIC HEARING DECEMBER 22, 1987 <br />The attached ordinance, agreement, and resolution would <br />establish a dependent special district under the_ Board of <br />County Commissioners for the sole purpose of disposing of <br />solid waste generated by residents of the district. <br />The district would be funded by a special assessment against <br />all developed property in the county and not by ad valorem <br />taxes. Additionally, service charges will be charged for <br />special wastes and services. The basic unit of charge will <br />be the amount of garbage generated by a single-family <br />residence (ERU), and the maximum yearly charge for disposal <br />is estimated to be between $26 and $30 per ERU. The <br />attachments to the ordinance show the ERU ratings of all <br />property in the county. <br />All five City Attorneys have indicated approval of this <br />district and have offered valuable input into it. At the <br />time this memo is being written, the cities of Fellsmere and <br />Indian River Shores have assented to it, and it is expected <br />that Vero Beach and Sebastian will give their consents by <br />December 16. <br />The special assessment charges are to be collected by the <br />Tax Collector on the ad valorem property tax bill as a <br />separate line item. Before this method of collection is <br />used, State law requires that a first-class mail letter be <br />sent to all property owners in the county. This was done. <br />The law also requires that the Property Appraiser consent to <br />the method of collection in writing. This agreement is <br />attached. Finally, the law requires that the Board of <br />County Commissioners adopt this collection method by <br />resolution and after a public hearing. This matter is <br />before the Board for adoption December 22, as is the <br />ordinance creating the district. <br />Representatives of the Utilities Department and the <br />consulting engineers, Camp, Dresser 8 McKee, will be present <br />to answer any questions you may have concerning the proposed <br />district. <br />Chairman Scurlock believed the Commission wants to apologize <br />to the community if there was any misunderstanding about the <br />letter that went out. It was our Attorney's opinion that the <br />language in that letter had to be very specific; however, the <br />Chairman did feel we could have put in another paragraph to <br />explain it better. <br />Many people apparently misunderstood the <br />D E C 2 2.1987 35 <br />eoof 70 Fnc-c 4i5 <br />
