JAN 19 1988 <br />BOOK 70 E 624 <br />reassess the County's right-of-way dedication policies. In the <br />beginning of 1987, the staff reviewed and analyzed current <br />right-of-way dedication policies, held several workshops <br />(including one with the Planning & Zoning Commission and another <br />with the Indian River Farms Drainage District), drafted the <br />proposed ordinance, and requested that the Board authorize <br />advertisement of the proposed ordinance. <br />Last May, the Board of County Commissioners authorized staff to <br />draft and advertise for ordinance changes affecting right-of-way <br />requirements. During the Summer and Fall, through several <br />iterations affected by court cases, new right-of-way policies have <br />evolved. These policies have been written into -the proposed <br />ordinance amendments and address the issues of equity, compen- <br />sation, and right-of-way corridor protection. <br />At its regular meeting of December 10, 1987, the Planning and <br />Zoning Commission unanimously recommended that the Board of County <br />Commissioners adopt the attached proposed ordinance amendments. <br />ANALYSIS: <br />. Issues <br />The amendments address several issues as follows: <br />Issue <br />Compensation <br />Reservations <br />Issue <br />Equity <br />Corridor <br />Protection <br />Existing <br />Requirements <br />Dedications may be <br />partially or fully <br />compensated for by <br />impact fee credit or <br />density transfer. <br />Reservations may be <br />used in lieu of dedi- <br />cations for minor site <br />plan applicants. <br />Existing <br />Requirements <br />Some applicants (dev- <br />elopers) are not fully <br />compensated for dedi- <br />cations. <br />Single-family <br />dwellings may be <br />constructed within <br />future rights-of-way <br />and corresponding <br />setback areas. <br />64 <br />Proposed <br />Requirements <br />All dedications <br />shall be fully <br />compensated for <br />by impact fee <br />credit, density <br />transfer, or <br />cash payments. <br />Reservations may <br />be used in lieu <br />of dedications <br />in any situation <br />where full com- <br />pensation for <br />needed r -o -w <br />cannot be given <br />at the time of <br />development <br />approval or <br />development. <br />Proposed <br />Requirements <br />All applicants <br />are fully com- <br />pensated for <br />dedications, the <br />same as property <br />owners whose <br />land the County <br />condemns. <br />Single-family <br />dwellings on <br />sites abutting <br />corridors must <br />conform to <br />future rights- <br />of-way; dedica- <br />tions and/or <br />reservations re- <br />quired. <br />
