. Proposed Ordinance <br />A. Section 1 adds three terms to the zoning code <br />definitions section. This section specifies the exact <br />meaning of dedicating, reserving, and compensating for <br />right-of-way, and it codifies for the first time the <br />County's existing working policies describing how an <br />applicant dedicates or reserves, and how the County <br />compensates. The reservation definition specifies what <br />uses are allowed within reservation areas. <br />,JAN 19 19 <br />B. Section 2 amends the site plan ordinance right-of-way <br />requirements, specifically establishing: <br />1. that right-of-way dedications/reservations are <br />needed where deficiencies exist; <br />2. that theburden of correcting deficiencies is equal <br />for property owners on either side of roadways, <br />except where canals or railroads limit expansion in <br />one direction; <br />3. that all applicants shall dedicate, where needed, <br />sufficient right-of-way to local road standards to <br />mitigate the impact of their projects (no compen- <br />sation given since the dedication is project - <br />related); <br />4. that the County may choose to compensate for <br />dedications by cash payment; <br />5. that reservation areas may be utilized in lieu of <br />dedication areas where full compensation cannot be <br />given immediately; <br />6. that in situations where a combination of <br />dedication and reservation areas is utilized, the <br />Public Works Director shall approve which area(s) <br />are to be dedicated and which are to be reserved; <br />and <br />7. amends all street type designations to correspond <br />with the new designations as per amendment to the <br />Comprehensive Plan. <br />C. Section 3 amends a General Provisions zoning code <br />section regulating development on single-family lots. <br />The amendment specifically establishes: <br />1. that development on single-family lots abutting <br />Thoroughfare Plan roads must conform to the <br />Thoroughfare Plan and observe future rights-of-way <br />and corresponding setbacks; and <br />2. all aspects previously described under analysis <br />Section B) 2-6. <br />It should be noted that the only single-family home <br />building permit applicants affected are those building <br />upon sites adjacent to deficient Thoroughfare Plan roads <br />and platted half streets. Also, it should be noted that <br />the existing restriction of access to a lower <br />functionally -classified road is merely re -written to <br />better integrate this regulation into the to -be amended <br />ordinance section. <br />D.
