In that regard, I would <br />suggest that consideration of the Association's application for amendment of <br />the land use designation for the property involved in the Boulevard Shoppes <br />site plan application (No. SP -MA -86-10-91) is improper for failure to be <br />accompanied by (1) the required fee, (2) a statement of authorization, <br />(3) statement of ownership, (4) certificate of title and (5) boundary survey. <br />I have applied for many CLUP changes over the past few years and have <br />never been excused from compliance with the rules. The Association, <br />although it represents a block of voters, is not exempt from the rules the <br />rest of us must follow. <br />Additionally, the Boulevard Shoppes project has been through three <br />Technical Review Committee meetings and will be reagendaed for the Planning <br />& Zoning Commission within the next couple of weeks. Absent adoption of a <br />moratorium by the Commission, which would surely be discriminatory and <br />illegal, nothing will stop the process in progress. My client has complied <br />with or satisfied every requirement of every department within the County, <br />deliberately made more onerous by the people who would now seek an <br />irregular change in the land use plan that my clients are entitled to, and <br />have, relied upon. <br />I am writing all of this because I feel that the County Attorney's office <br />is obliged to address legal matters, even if it does not agree with them, on <br />matters scheduled before the Commission. <br />Awaiting your advice, I remain <br />MOH/pkm <br />cc Leonard L.
