Farber, Inc. of Fort Lauderdale, pointed out that he <br />has 5 or 6 applications pending for changes to the Comprehensive <br />Land Use Plan for individuals and corporations who own land in <br />the county, and in each case, he has a court reporter present. <br />He felt that there are deficiencies in this request compared to <br />what he has been required to do in his applications for land use <br />changes. He emphasized that his clients have had to pay $500, <br />$900, or whatever it might be, to provide a survey, a certificate <br />of title, and any number of things that this Board in its wisdom <br />has required for land use plan changes. Those requirements are <br />made with good reason, but he has seen none of those things in <br />this particular petition. He pointed out that although two <br />lawyers and a traffic engineering consultant are representing the <br />applicants this morning, the legal description includes property <br />that is presently in use as multiple -family and excludes property <br />which is zoned and is being site planned for commercial use that <br />is immediately adjacent to his client's property. The <br />requirements for consideration of a change to the Comp Plan are <br />there for a good reason and are not there to be selectively <br />enforced because one applicant has more political clout than <br />another. He believed that is precisely the situation here, and <br />that it is improper for the Commission to consider an application <br />for changing the Comp Plan that does not meet the requirements <br />when his private clients do not enjoy that advantage or that <br />opportunity and have to spend the money and take the time to <br />satisfy alt requirements involved in a land use change <br />application. <br />Chairman Scurlock felt that was incorrect, because in this <br />case, the County is being requested to initiate the rezoning. He <br />emphasized that in many cases this county has taken the <br />initiative and no fee has been charged. <br />28 <br />
