Attorney O'Haire asked what would happen if he requested <br />county -initiated land use amendments for his clients that would <br />obviate the requirements of the applications. <br />Chairman Scurlock felt the question involved is broad <br />community effect. This particular project probably is affecting <br />1500 families and the entire community, and he felt the effect is <br />of such a broad nature that it goes far beyond one specific <br />parcel. Chairman Scurlock stressed that we have not denied <br />anyone their rights, because the purpose of this meeting is to <br />decide whether or not to have a public hearing to consider the <br />issue. <br />Attorney O'Haire stated that whatever action is taken today <br />will not affect any pending application for site plan approval. <br />If the County pursues this once site plan approval has been <br />granted, it will create a non -conforming use for his client's <br />property. He opposed the Board's consideration for the reason <br />being that it is against every concept of good planning. <br />Attorney Vitunac explained that the people here are asking <br />the County to undertake this rezoning, and if the County does it, <br />it will be done for the public good, not for the developer. He <br />advised that Attorney O'Haire can ask the. County to undertake his <br />client's rezoning too, and if it is a publicly important matter, <br />the County may do that. <br />Commissioner Eggert asked what happens if they do, indeed, <br />have an approved site plan, and Attorney Vitunac explained that <br />Attorney O'Haire's client will proceed as if nothing has happened <br />until something does happen. If the rezoning occurs before his <br />rights are vested, his client cannot proceed with the <br />development. The County cannot declare a moratorium or put any <br />hurdles in his way that we don't with other people. The County <br />puts many hurdles in the way of all developers, but they are all <br />there for the public good.
