ASSIGNMENT OF LICENSE TO OCCUPY AND IMPROVE COUNTY PROPERTY: OLD <br />"FLORIDA CABLEVISION" SITE SOUTH OF 16th STREET <br />The Board reviewed the following memo dated 1/15/88: <br />TO: Char! P. Balczun, County Administrator <br />THROUGH: Cha s P. Vitunac, County Attorney <br />FROM: .�,� William Collins, Assistant County Attorney <br />DATE: January 15,1988 <br />RE: <br />Assignment of License to Occupy and Improve County <br />Property -- Old "Florida Cablevision" Site South <br />of 16th Street. <br />The County granted Clark DePue a non-exclusive license <br />to occupy and use County real property on October 2, 1985. <br />The County can terminate the license by giving ninety (90) <br />days written notice. <br />Mr. DePue wishes to assign his license to occupy and <br />= use the property to a client of Sam Block, Esq. Assignment <br />is not permitted "without prior written approval of the <br />Board of County Commissioners of Indian River County, which <br />consent shall not be unreasonably withheld" (Paragraph 10 of <br />the License agreement). Mr. DePue has made all necessary <br />improvements called for by the agreement, i.e., curb cuts, <br />parking, stormwater management, landscaping, etc. The <br />right-of-way of 16th Street which the improvements occupy is <br />not anticipated to be needed for ten years or thereabouts. <br />The property has 95 feet of frontage on 16th Street and runs <br />62 feet south of the currently utilized right-of-way. <br />I present for the Board's consideration the current <br />License Agreement with Mr. DePue, and the Assignment form <br />drafted by Sam Block which appears satisfactory. Mr. Block <br />has told me that the anticipated tenants of the new <br />licensee, Gregory D. Bone as Trustee, will be two radio <br />stations. <br />Mr. Block has requested this assignment be considered <br />by the Board at their January 26, 1988 meeting, so as to <br />accommodate a February 15th, 1988 closing on the old <br />"Cablevision" property. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Wheeler, the Board unanimously <br />approved the Assignment of License to Occupy and <br />Improve County Property for the site known as the Old <br />"Florida Cablevision" site south of 16th Street. <br />ASSIGNMENT OF LICENSE IS ON FILE IN THE OFFICE OF THE CLERK <br />59 <br />JAN 261988 <br />E100K 70 DE 717 <br />
