The County will get a general warranty deed, not <br />a special warranty deed, so the word special is taken outthree (3) <br />different places in the agreement. <br />After considerable discussion and review, the Board <br />indicated their agreement to the following changes in the <br />proposed Contract for Sale and Purchase: <br />Section 14.01 - The Seller will pay his own attorney fees. <br />Section 14.04 - Delete the word "special" <br />Section 14.05 - Delete the word "special" <br />Section 17.01 - Insert $1,000 per ERC in the blank space. <br />Section 18 (indented paragraph) changed to read: <br />"By accepting this deed, for the next 5 years, the <br />grantee agrees that (i) it shall not construct <br />improvements on the real property or modify <br />improvements already constructed thereon (if said <br />modification would cost in excess of $25,000) without <br />the prior written consent of the grantor, its <br />successor or assignee of this specific power, which <br />consent shall not be unreasonably withheld provided <br />the proposed improvement or modification of <br />architecture and landscaping is compatible with the <br />adjoining residential developments' architecture and <br />landscaping and that (ii) the use of the real property <br />shall be restricted, perpetually, to a public <br />library." <br />Section 18 - Delete entire third paragraph <br />Brooks Brierly, representing the seller, Sebastian Lakes <br />Associates, indicated his agreement with the above changes. <br />ON MOTION by Commissioner Bird, SECONDED by <br />Commissioner Eggert, the Board unanimously approved <br />the proposed Contract for Sale and Purchase of the <br />north county library site from Sebastian Lakes <br />Associates, with the changes as set out above, and <br />authorized the Chairman's signature. <br />62 <br />
