Finney, RA <br />Right -of -Way Acquisition Agent <br />DESCRIPTION AND CONDITIONS <br />The county has been in negotiation with Mr. Bud Jenkins to <br />acquire a 150' wide by 1800' right-of-way for 53rd Street west of <br />and joining the FEC Railway property. The r/w corridor is shown <br />on the Thoroughfare Plan as a primary collector from the northern <br />terminus of Indian River Boulevard to 82nd Avenue with a possible <br />future extension to an I-95 interchange and thus becoming a major <br />east -west corridor. <br />The property has been mined by Mr. Jenkins and part of the <br />proposed r/w consist of a lake. The Board previously requested <br />that we work with Mr. Jenkins to arrive at a settlement whereby <br />he would cooperate to sell the r/w property and fill in the 150' <br />wide corridor thru the lake. <br />The July 1986 appraisal of the r/w was $59,000. Mr. Jenkins <br />originally offered to sell & fill the roa4way_ for $225,000. <br />Staff offered $169,000. <br />Mr. Robert Pegg, attorney for Mr. Jenkins, has submitted a <br />recent counter offer indicating that his client will settle for <br />$185,000 with three equal payments. <br />Computation of the costs are as follows: <br />1) Land 150'x1800' 6.2 acres ($ 9,710/acre <br />2) 85,555 cubic yards fill at $1.46 <br />Filled (completed) equates to $29,838. per acre <br />$185,000. <br />$ 60,202 <br />124,910 <br />$185,112 <br />total cost <br />Staff has reviewed the negotiated offer and recommends approval. <br />RECOMMENDATION AND FUNDING <br />Staff request authorization to purchase at $185,000 with <br />funding to be from account zone 4 Traffic Impact Fees and local <br />option gas tax revenue. <br />Director Davis noted that if we don't acquire this now, <br />later on we probably would have to import the fill rather than <br />utilizing the existing fill currently on the site that will be <br />mined and sold to a private interest unless we purchase it. <br />34 <br />
