Keat. ng, CP UBJECT: Proposed Amendment to <br />Community Develop'ent Director Section 25(r) Mining <br />and Excavation <br />FROM: Michael K. Miller PO. REFERENCES: P&Z MEMO/MINING ORD. <br />Chief, Environmental Planning DISK: MIKE <br />& Code Enforcement <br />It is requested that the data presented herein be given formal <br />consideration by the Board of County Commissioners at their <br />regular meeting of March 22, 1988. <br />DESCRIPTION AND CONDITIONS: <br />Recently, the Board of County Commissioners directed the staff <br />to make a comprehensive revision to the mining ordinance. The <br />staff has examined issues relating to lake development and mine <br />restoration, and limited protection for the Coastal Sand Ridge,, <br />in addition to mining issues such as bonding, ground water <br />quality, exemptions, and the identification of hauling routes. <br />The financial impact of the proposed regulations has also been <br />analyzed, and the results of the analysis are presented in an <br />economic impact report that is attached to the agenda item. <br />During the last 6 months, 3 workshops were conducted by the <br />staff, and discussion focused primarily on the cost of meeting <br />littoral zone requirements and the establishment of hauling <br />fees to mitigate the damage to the haul routes due to sand <br />truck traffic. By the conclusion of the workshops, the littoral <br />zone requirements had been modified, and the concept' of hauling <br />fees had been deleted from the proposed ordinance. The hauling <br />fee issue was dropped with the understanding that public <br />discussion of the need for additional revenue to repair road <br />damage primarily caused by sand trucks will continue, and <br />methods for generating such road repair funds may be examined <br />in the future.. <br />The Planning and Zoning Commission, at the January 28, 1988, <br />Planning and Zoning Commission Meeting voted 5 to 1 in favor of <br />recommending adoption of the proposed ordinance to the Board of <br />County Commissioners. <br />ALTERNATIVES AND ANALYSIS: <br />The proposed ordinance addresses three principal issues: <br />1. Zoning districts where mining is permitted; <br />2. Water management standards for lakes; and <br />3. Mining of the Coastal Sand Ridge. <br />Zoning Districts - The present mining ordinance restricts <br />mining activity to an Administrative Permit use in the A-1, <br />Agricultural Zoning District. The proposed ordinance retains <br />mining activity as an Administrative Permit use in the A-1, <br />Agricultural District and expands mining activity as a Special <br />Exception use in Residential, Commercial and Industrial Zoning <br />Districts.
