Vitunac, County Attorney <br />FROM: Sharon Phillips Brennan, Assistant County Attorney SF <br />DATE: March 8, 1988 <br />SUBJECT: Late Night Retail Stores Ordinance <br />This office was requested to notify the Board of any <br />action taken by the City of Vero Beach concerning the <br />referenced ordinance. <br />On March 1, 1988, the City adopted the attached <br />ordinance which, among other things, requires Late• Night <br />Retail Stores to either: <br />1. have a minimum of two (2) employees on the premises <br />from 11:00 p.m. until closing or 7:00 a.m., <br />whichever occurs first; or <br />2. construct a self-contained pay booth meeting <br />standards contained in the ordinance for protection <br />of the cashier(s); or <br />3. install an audio visual monitoring system which <br />allows security personnel live access to the <br />operation 24 hours a day. <br />If the Board requires further information about this <br />type of ordinance, I will be happy to provide it. <br />Commissioner Eggert asked if anyone is interested in taking <br />this ordinance or a similar ordinance to Public Hearing. <br />Chairman Scurlock really had a problem with interfering with <br />private business, and Commissioner Bird felt that he would like <br />to observe how the various cities' ordinances work before we jump <br />into one. <br />Chairman Scurlock felt it is a labor/management problem, but <br />Commissioner Bowman pointed out that labor is not organized and <br />it is either take the risk or don't take the job. <br />Commissioner Wheeler felt that this is a bandaid effect and <br />in the long haul, it would be putting more people at risk, and he <br />would not be in support of it. <br />WAR 2 2 1988. <br />5 6 BOOK l 1 F''E 355 <br />
