Since the subject property has recently been acquired by a <br />new developer, the new owner must transfer the utilities <br />franchise pursuant to County regulations. To effect the <br />transfer,.a public hearing and action by the Board of County <br />Commissioners is necessary. As of this time, the applicant <br />has not transferred the franchise nor paid the required <br />franchise fees. <br />The Utilities Department has requested that the franchise <br />transfer be completed prior to any site plan approval to <br />ensure that the proposed project will be adequately served by <br />a legal utilities franchise. <br />9. Stormwater Management Plan: The Public Works Department has <br />reviewed and approved a conceptual drainage plan. <br />10. Traffic Circulation: The site will use the existing Marsh <br />Island drive to access C.R. 510. <br />11. Dedication and Improvements: The project must satisfy the <br />public access to waterbodies requirements through both the <br />subdivision ordinance section [10r] and site plan ordinance <br />[23.3i]. These provisions will be more specifically <br />addressed at the time of preliminary PRD review. <br />12. Waivers: Through the PRD process, the applicant is <br />requesting the following waivers: <br />1. a waiver from standard road right-of-way requirements; <br />2. a waiver from the 20' building separation distance, and <br />3. pursuant to existing County policy, the recreational <br />vehicle space requirement normally applied to multi- <br />family projects may be waived if recreational vehicles <br />are prohibited from using or parking on the site. The <br />applicant is proposing such an arrangement. <br />Staff supports these requests, based on the submitted concept <br />design and allowances specified in th PRD ordinances. <br />RECOMMENDATION: <br />Staff recommends that the PRD special exception and conceptual <br />plan approval be granted by the Board of County.Commissioners with <br />the following conditions: <br />1. Prior to any site plan or preliminary plat approval, the <br />applicant complete the necessary procedures to transfer- <br />ownership of the utilities franchise with the County <br />Utilities Department; and <br />2. The applicant make provision to satisfy the access to public <br />waterbodies requirements at the time of preliminary PRD <br />approval. <br />3.
